Privacy and cookies

This information applies when you use Konkursbevakning in a bankruptcy case.

Who is responsible for the personal data?

When you use Konkursbevakning, the processing relates to a specific bankruptcy case. The bankruptcy estate in that case is the controller for the processing within the bankruptcy estate’s activities and is represented by the responsible trustee in bankruptcy. Names and contact details are shown in the bankruptcy’s case room and in messages about the case.

Arendivo AB provides the technical service Konkursbevakning and processes personal data as a processor under a data processing agreement, documented instructions and decisions from the controller.

Access applies to this bankruptcy only

Your verified email address is used to create a technical case participant in the bankruptcy concerned. It is not a central account with Konkursbevakning. Email verification, sessions, drafts, access rights and your own claims are tied to the same bankruptcy. If the same email address is used in another bankruptcy, a separate case participant is created and the information is not linked automatically.

What data is processed?

The data needed to identify you as a participant in the bankruptcy case, verify your email address and handle your matters in the portal is processed. This may include, for example, name, email address, telephone number, corporate ID number or personal identity number, information about claims, attachments, bank details and technical security and audit information.

The data may come directly from you or from the material in the bankruptcy case, for example information that the responsible trustee, another party, a court or a supervisory authority has provided or made available for the handling of the case.

Why is the data processed?

  • To verify your email address and give secure access to the right bankruptcy case.
  • To receive, register, review and follow up claims, supplements and responses.
  • To show the status, documents, messages and information that you are entitled to see in the case.
  • To communicate with the parties concerned, courts and the supervisory authority when needed in the bankruptcy case.
  • To protect the case room against unauthorised access and to document critical actions.
  • To meet requirements that follow from the bankruptcy procedure and other applicable law.

Legal basis

The controller determines and documents the legal basis for each processing operation in the bankruptcy case. The processing in the portal takes place so that the trustee can carry out the bankruptcy assignment, handle the claims and objection procedures, deal with legal claims and meet applicable legal and documentation requirements. Consent is not used as the legal basis for processing that is necessary for handling the case.

Who may receive the data?

Data may be disclosed to the trustee in bankruptcy and the trustee’s organisation, the bankruptcy estate, the parties concerned and their representatives, courts, the supervisory authority and other recipients when needed for the bankruptcy case or required by law. Arendivo AB and approved technical sub-processors process data on behalf of the controller in accordance with agreements and instructions.

How long is the data kept?

Case data is kept for as long as the controller needs it for the bankruptcy procedure, legal documentation and applicable retention requirements. Technical access and security data is kept for as long as it is needed for secure and traceable operation. Arendivo AB deletes or returns data in accordance with the controller’s instructions and the data processing agreement.

Security

The service uses access control, encryption, traceability and restricted access. Every protected access is checked against the bankruptcy concerned and the rights that the responsible trustee has decided on.

Your rights

Depending on the processing and its legal basis, you may have the right to request access, rectification, erasure or restriction and to object to the processing. These rights may be limited by the bankruptcy procedure and other legal requirements. Requests are assessed by the controller for the bankruptcy case, not by Arendivo AB.

Contact the responsible trustee or the trustee organisation stated in the bankruptcy case. Arendivo AB assists the controller with technical information when needed to handle your request.

You also have the right to lodge a complaint with the Swedish Authority for Privacy Protection (IMY).

Technical questions

If the portal is not working, you can contact kontakt@konkursbevakning.se. Arendivo AB handles technical support for the service but does not make decisions about the bankruptcy case, your access or how your rights are to be met.
